The implication of trademarks in the marketing of ‘smell-alike’ perfumes was first examined in the case of L’Oreal v Bellure heard by the Court of Appeal for England and Wales, and the European Court of Justice. The courts were in disagreement in the interpretation of ‘unfair advantage’ taken by the defendant of the plaintiff’s trademark. Had the matter been heard by the South African courts, the question would have been one of competing rights and not of the analysis of trademark infringement.
